Time Element Advisory
Complex claims demand disciplined resolution.
OA&R provide advisory services to facilitate the successful resolution of Time Element insurance claims, with our collaborative and transparent approach providing all stakeholders with an enhanced claims experience.
We work by reducing complexity to its essential elements, facilitating understanding and creating the conditions in which informed resolution becomes possible.
Valued for our approach, expertise and experience in defining delay as a consequence of damage, our main areas of focus include:
Delay Analysis (DSU)
Analysing delay is of paramount importance when establishing entitlement under a Delay in Start-Up (DSU) claim. A successful delay analysis will equitably determine the number of days delay resulting from an insured event and establish the date from which the indemnification will commence, often known as the Scheduled Commercial Operation Date (SCOD).
As DSU asks a question that is fundamentally different to delay considerations under construction contracts, specialist knowledge and experience is required to successfully advise on matters relating to DSU entitlement.
OA&R's advisors are able to assist in the following:
-
Delay to Commercial Operation Date (COD)
-
Pre-Incident Project Status
-
Critical Path and Float
-
Concurrent / Parallel Delays
-
Increased Cost of Working (ICOW)
-
Additional Increased Cost of Working (AICOW)
-
Prolongation
-
Expediting Expenses
-
Defect Exclusions (LEG and DE)
-
Project Monitoring
-
Marine Cargo DSU
-
Policy Endorsements and Multiple Deductible Periods
Timeline Analysis (BI)
OA&R’s advisors work with stakeholders to assist with determining the reinstatement periods directly attributable to insured event(s).
OA&R approach operational Business Interruption (BI) claims with a proactive approach to keep all stakeholders appraised at regular intervals;
-
Early consideration of proposed acceleration measures,
-
Monitoring shifts to the critical path and changing timeline risk and mitigation options,
-
Outline the impact of planned / opportunistic maintenance or turnaround works,
-
Outline any incremental impact of upgrade and improvement works.
Early engagement of OA&R’s advisors allows reinstatement projects to maximise the benefit derived from our involvement to minimise the interruption and to arrive at earlier resolution of time element claims.
